Welcome to FitPerfect AI. These Terms of Use ("Terms") govern your use of the FitPerfect AI app, website, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Your Account

You must be at least 13 years old (or the minimum age required in your country) to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to update it when it changes.

2. The Service

FitPerfect AI estimates your body measurements from photos you upload and recommends clothing sizes based on those estimates, your stated preferences, brand and fabric data, and current trends. Recommendations are estimates only and do not guarantee the fit of any specific garment. Actual fit may vary due to brand sizing inconsistencies, fabric composition, manufacturing tolerances, body posture, and other factors beyond our control. Always consult the retailer's size chart and return policy before purchasing.

3. Membership and Billing

Full access to the Service requires a membership, currently priced at $4.99 per month. Billing is handled by our payment provider. Your subscription renews automatically each month until you cancel. You can cancel at any time from Settings; access continues until the end of the current billing period. We may change the membership price with reasonable advance notice. Refunds are governed by the payment provider's policies and applicable law.

4. Acceptable Use

You agree not to:

Upload photos of other people without their consent, or content you do not have the right to use.
Use the Service to harass, deceive, or harm others, or to violate any law.
Attempt to access data or systems you are not authorized to access, or to disrupt the Service.
Reverse engineer, scrape, or resell the Service or its output without our permission.
Upload content that is unlawful, infringing, or otherwise prohibited by these Terms.

5. Your Content

You retain ownership of the photos and other content you upload ("Your Content"). You grant us a limited license to use Your Content solely to provide and improve the Service for you, such as calculating your measurements and generating your sizing profile and try-on model. You are responsible for ensuring you have the rights to upload Your Content and that it does not violate these Terms or any third party's rights.

6. Privacy

How we handle your data is described in our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The Service, including its design, software, recommendations engine, and brand materials, is owned by FitPerfect AI and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or content except as needed to use the Service for your personal, non-commercial use.

8. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any size recommendation will be accurate or suitable for you.

9. Limitation of Liability

To the fullest extent permitted by law, FitPerfect AI and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your account is inactive, or to protect the Service or our users. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated version in the app and revise the "Last updated" date above. Continued use after changes take effect means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which FitPerfect AI operates, without regard to conflict-of-laws principles. We will work to resolve any dispute informally wherever possible.
